The property is watered by several dams as well as a new solar pump and panels pumping abundant water from a spring fed cistern.

Operation

This property has historically been used for grazing livestock and is fenced on the south and west boundaries. Livestock water is provided by a solar powered water well and 2 dams. The north dam has recently been rebuilt and is in excellent condition. 

Topography

The majority of the property lies along a ridge descending toward the south shore of the White River. Several treed draws drain to the east and provide shelter and shade for both livestock and wildlife.  

Leases

The current tenant’s grazing lease runs thru Dec 31, 2026, rental $11,375 annually. No hunting rights included in the lease. Additionally, there is 160 acres of Tribal ground along the northwest boundary, which is fenced in with the property.  Tribal lease does not transfer with title.

Sand and Gravel Pit

21,000 tons of sand were marketed in 2021. A significant stockpile remains on the property with more sand and gravel available for harvest.

The Preliminary Title Commitment is available online. An owner’s policy of title insurance will be provided with cost divided equally between Buyer and Seller.   

The property is being sold “as-is, where-is” and each bidder should conduct his/her own due-diligence related to the property.   

The bidder acknowledges that if a bid is submitted during the auction, the bid may become the high bid and therefore obligate the bidder to purchase the tract(s) or parcel(s) at the bid price.   

The minimum bid increase will be set prior to each auction. Bids will be recognized in the order received.  

Hewitt Land Company reserves the right to reject any and all bids for any reason. It also reserves the right to cancel an auction or remove any item or lot from this auction prior to the close of bidding. All decisions of Hewitt Land Company are final.  

The winning bidder will be required to complete, sign and return the real estate contract without modifications following the auction. The winning bidder will be required to provide 15% non-refundable earnest money deposit as stated in the contract. The purchaser will be responsible for any related fees. Should the winning bidder not comply within the stated time frame, he/she shall be held responsible.  

Both the winning bidder and Seller shall hold harmless Hewitt Land Company for any liabilities or expenses resulting from either Bidder’s or Seller’s failure to fulfill any obligations set forth in these Terms and Conditions.  

Property sells subject to seller confirmation. Property sells subject to existing lease agreement expiring 12/31/2026. At the conclusion of the auction successful bidders shall enter into a purchase agreement and deposit 15% nonrefundable earnest money with the balance due in certified funds upon closing, on or before March 15th, 2023. Any early closing will be upon mutual consent. Property will be sold without buyer contingency of any kind. Have financial arrangements secured prior to bidding. Deeded property sold by legal description only.  Any survey required shall be at the expense of the buyer. Property selling “As-is where is”. Inspect to the extent deemed necessary both on and off premises and use your own judgement when bidding. Possession: Property sells subject to the rights of the tenant and the existing lease terminating 12/31/2026.   

Title:  Marketable title will be transferred by Warranty Deed and Assignment, subject to easements, restrictions, covenants and/or reservations of record. A title insurance policy will be provided by Seller and is available for your inspection prior to the auction.  

Taxes: Seller will pay 2022 taxes based on the most current tax levy available. The 2023 taxes shall be prorated to the day of closing.
